Upon the sale of a property the builder sets a tentative date of occupancy. The builder is allowed to change this date as often as needed as the build goes forward; however, they must follow very specific rules. Often builders don't fully understand these rules, or make administrative mistakes. Unfortunately most consumers do not realize that they are eligible to receive the benefits so they never apply.
